FIT Bearings Acquires ISO 9001:2008

FIT Bearings, a USA based, privately held company, has acquired the ISO 9001:2008 Quality Management System Certification. After extensive quality systems analyses by the Shanghai YuanCheng Consulting Co., Ltd., FIT Bearings earned the certificate in August, 2008.

YuanCheng Consulting is one of the largest and most influential consulting companies in China, mainly engaged in certifying, management consulting, management training, brand & marketing consulting, and information services. They were one of the first to be approved as a certifying company by the China Certifying Supervision Committee.

ISO 9001:2000 and ISO 9001:2008 are the internationally recognized standards for quality. Certification reassures your customers that your organization is fully committed to quality by continuously undergoing the scrutiny of an accredited third party certification company.

FIT Bearings was established in 1988, and since its beginning, has strived for excellence in quality products for our customers. A few years back, the U.S. economy was booming, and so was its business with China. Today, because of its cheaper labor rates, and rapidly growing domestic market, which includes 400 million Internet users and 700 million mobile-phone subscribers, China remains somewhat enticing. However, new obstacles are making it more difficult for U.S. companies to buy and sell direct with China. In fact, some businesses, big and small, are finding out that doing business direct with China is not at all like it was in the past.

Large American companies such as Hewlett-Packard and General Electric have spent billions of dollars in setting up world-class research and development centers in China, but as China's business sectors have matured, their government has started to shift emphasis on to nurturing their own corporate companies in order to become global competitors. Emboldened by their nation's rising economic position, China has increased demands on foreign companies. For example, the Information Technology Industry Council, which represents many U.S. companies, said that one example of the new hurdles its members face in China is the government procurement policy that require that products contain intellectual property developed and owned in China. Tech companies also face new Chinese rules, including the requirement that products adopt local technology standards. What this means is that companies often must create two versions of a product, one for China and one for the global market. China Mobile, for example, is reportedly close to an agreement with Apple regarding the I phone, but Apple will have to reconfigure the device to run on China's standard, which will be used only in China.

FIT Bearings' Shanghai Operations building project nears completion

From its ground breaking inception on June 28, 2007, FIT Bearings' new facility for its Shanghai Operations/QC Center is nearing completion. The construction is expected to be completed in time for the grand opening ceremony to occur during the same period as that of the Shanghai World Expo opening on May 1, 2010. The new facility is located on the east side of the Shanghai SongJiang Industrial Zone (SJIZ), east of downtown SongJiang in the southwest part of Shanghai.

The SJIZ was the first municipal-level industrial zone approved by the Government of Shanghai. To date, there have been over 500 foreign investments in to this zone, with an amount totally more than 8.43 billion U.S. dollars. Of these investments, more than 60 are internationally renowned multinational companies from the world's "Fortune 500". FIT Bearings' new facility is invested and headed by its U.S.A. headquarters, with a registered capital amount of four million U.S. dollars, and a total investment amount of over eight million.

To a degree, Zhejiang Fit Bearing Co., Ltd. complies regarding infringement rights.

As FIT Bearings' corporate attorney prepared to take legal action against Zhejiang Fit Bearing Co., Ltd. in the United States and with the WIPO in China , we discovered that on their website they had changed the "FIT" brand to "CCF" brand.  Therefore, FIT Bearings has decided to temporarily suspend all legal action against Zhejiang Fit Bearing Co., Ltd.  However, should further violations be discovered under FIT Bearings' close monitoring, we will reserve our right to resume all legal avenues.

We believe that Zhejiang Fit Bearing Co., Ltd. will not violate again any of FIT Bearings' trade marks.

Update - Another Chinese company tries to profit off of FIT Bearings' good name.

In our April News, we reported that Zhejiang Fit Bearing Co., Ltd. of Xinchang, Zhejiang, China, who is not related to FIT Bearings whatsoever, has been trying to profit off of FIT Bearings' good name.  After FIT's stern warning to initiate legal action through the WIPO, we noticed a change on Zhejiang Fit Bearing Co., Ltd.'s website.  Please see below.

Clearly, this change can be construed as an acknowledgement of Zhejiang Fit Bearing Co., Ltd.'s deceptive and unethical conduct of intentionally trying to skate on FIT Bearings' good name.  Replacing the flashing words of "FIT Bearing" with "CCF Bearing" is not going to be sufficient, though, because the company continues to show the words "FIT Bearing" in their name. Unless Zhejiang Fit Bearing Co., Ltd. immediately removes all references related to "FIT Bearing", we reserve our right to continue with our legal action against them.  Specifically, this includes the removal of "FIT Bearing" from their website, internet advertising, printed materials, and all other sources of advertisement.

FIT Bearings will go after any and all companies that try to profit off of their good name.

Another Chinese company tries to profit off of FIT Bearings' good name.

FIT Bearings has retained an intellectual property attorney specialized in international trademarks, regarding a trademark dispute. In another apparent attempt to skate on the good name of FIT Bearings, another company, Zhejiang Fit Bearing Co., Ltd. of Xinchang, Zhejiang, China, who is not related to FIT Bearings whatsoever, is infringing on property rights, misappropriating the FIT Bearings trade name, using unlawful and deceptive trade practices, false advertising, and intentionally trading on FIT Bearings's goodwill in order to unjustly profit.

On Zhejiang Fit Bearing Co., Ltd.'s URL, they clearly show and state that their trademark is CCF. However, located in plain sight on their home page, they blatantly advertise FIT Bearings. Viewers searching the web for the "legitimate" FIT Bearings, can easily stumble onto CCF's website, mistaking them for us. This type of action is deceptive and unethical.

Zhejiang Fit Bearing Co., Ltd. has been asked to cease and desist from all direct and indirect use of "FIT Bearing" in any of its products, website, advertisements, and/or literature. Established in 1988, FIT Bearings has several registered trademarks, and is committed to doing what is necessary to safeguard them.

On 02/27/07, FIT Bearings applied for registration with the Government of China, and the approval status is pending.

Despite FIT Bearings' courteous request, there has been no response from Zhejiang Fit Bearing Co., Ltd. Therefore, we are left with no alternative but to seek action in this matter. FIT Bearings intends to file a formal complaint with the WIPO Arbitration and Mediation Center, an international provider of non-profit services for the out-of-court resolution of commercial disputes. The Center specializes in cases arising from technology and intellectual property transactions, such as licensing, R&D, and distribution agreements.

On December 17th, 2007, in a website trade name dispute against Ningbo Flight International, a panel with the WIPO awarded the legal ownership of the URL, www.fitbearing.com to FIT Bearings.

2008 China International Bearing Industry Exhibition rolls smoothly

The China Bearing Industry Association held it's 11th exhibition this year.  The 2008 fair was held September 23-26, at the Shanghai Everbright Convention & Exhibition Center.  The 600 or so exhibitors were renowned bearing corporations and factories, from countries such as the U.S. , Japan , Germany , Italy, the UK , Sweden, France, Korea , Spain, Switzerland , Singapore , Russia, India, Taiwan , China , and Hong Kong 's Special Administrative Region.

The purpose for the exhibitions is for bearing industry enterprises to come together to compare and learn from each other.  In a friendly atmosphere, old and new friends alike get together to discuss bearing related topics.  FIT Bearings welcomed the new exhibitors this year, and further enjoyed all who visited our Logistics/QC in Shanghai.

Kicking off in 1990, and after 16 years of development, the China International Bearing Industry Exhibition (CIBIE) has matured internationally, and has become the world's largest professional bearing industry event.  By 2006, the exhibition, which was also held at the Shanghai Everbright Convention & Exhibition Center , covered an area of 32,000 sq.m., housed 538 exhibitors from 17 countries, and accommodated more than 80,000 visitors.  Enterprises from 34 countries participated in bearing discussions.

China takes the gold

The 2008 summer Olympics, held in Beijing, China, was a great success on all fronts. The opening ceremony at the newly constructed Bird’s Nest stadium was a magnificent show, unlike any opening ceremony in the history of the games. China was golden, as their athletes topped the charts with 51 gold medals, which was the largest gold count in 20 years. The United States topped the overall medal count with a record breaking 110, and was second in gold medals with 36.

FIT Bearings would like to congratulate all athletes who won medals at this year's games, and we wish them the best for the future.

In our continued efforts to improve operations, FIT Bearings is revamping its database system. Its current legacy system, albeit effective, cannot compare to the modular programs which accompany SAP. Additionally, linking all our offices, and maintaining room for growth, will help us continue streamlining our processes and inventory management.

Moreover, to maintain our excellent customer service, FIT Bearings has been using the CRM System (Customer Relationship Management) since March 2004.

Global Steel Prices Nearly Double in a Year

During the past year, steel prices soared, as iron and steel manufacturers were forced to accept huge price increases from iron ore and coke producers. The brunt of the increase came in February and March, but prices continue to rise on a daily basis. This may bring new problems to manufacturers, as strong demand on emerging markets has brought about inflationary pressures. Also leading to the high demand has been the infrastructure spending toward urbanization in Asia, the Middle East, and other regions.

By May 2008, the billet price soared up to US$900 per ton, almost doubling within a year. Billets are used in the production of steel, mainly for construction purposes. It is also used as the steel industry index.

According to data from 2003-2008, the international iron ore prices increased by 8.9%, 18.62%, 71.5%, 19%, and 65%, respectively; thus, nearly tripling during the past five years. As a result, coking coal prices increased, which in turn, forced tremendous increases in steel and iron prices. During the past three to four months, steel prices have risen by about 50% in the U.S., making the soaring steel prices a global trend.

At this juncture, growing imports will not be sufficient to relieve the tight supply in the market in the short term. Consequently, transaction values will most likely climb through the middle of the year. However, ordering is likely to be kept to a minimum, due to credit restraints being imposed by lenders, restricting buyers on volume steel purchasing. Steel prices are expected to continue to rise through the second quarter. Over the summer, due to lower levels of buying activity, price increases should come to a halt.

The economic outlook for the second half of 2008 is uncertain, especially with the threat of a US recession remaining high, which may lead to a drop in steel consumption.

The credit crunch will also have an affect on new projects. Consequently, a fall in transaction values is expected. Most selling figures should recover by a small amount in 2009, as inventories will need to be restocked.

Shanghai FIT Bearings makes a contribution of RMB10,900 to the China earthquake relief fund.

A deadly earthquake rocked Southwestern China on Monday, May 12th, 2008, in the county of Wenchuan, located in the Eastern Sichuan Province. Wenchuan County took a significant hit, as it was the heart of the disaster area. The loss of life was significant. According to the report by The Ministry of Civil Affairs, there were 69,181 people confirmed killed, 374,171 wounded, and 18,498 unaccounted for.

Shanghai FIT Bearings donated 10,900 RMB for subsidization to the Earthquake Relief Fund. The donation was delivered to the Shanghai Songjiang District Industrial Management at the China State Council Earthquake Relief Headquarters.

FIT Bearings' Wins Web Address Action Against Ningbo Flight

In December, 2007, the WIPO panel ruled in favor of FIT Bearings complaint that Ningbo Flight International registered and used www.fitbearing.com in bad faith, and awarded the legal ownership of the URL,www.fitbearing.com to FIT Bearings. Since that ruling, Ningbo Flight International registered www.fitbearing.net. A warning was issued, and FIT Bearings will continue to fight all attempts to use our registered trade name in bad faith.

WIPO awards domain name to FIT Bearings

Christmas will certainly be a joyous one this year. On December 17th, after careful consideration of
FIT Bearings' complaint filed on October 12, 2007 against Ningbo Flight International, a panel with the WIPO agreed with our argument, and awarded the legal ownership of the URL, www.fitbearing.com to FIT Bearings. We thank the law firm of Garvey Schubert Barer in assisting with the defense of our registered trademark.

The WIPO panel found the following:

Identical or Confusingly Similar

FIT Bearings, www.fitbearings.com, has shown sufficient evidence that it has registered trade mark rights and it continues to have such rights in the United States of America, and that it has acquired common law rights through long and extensive use of the trade mark. In addition, the disputed domain name, www.fitbearing.com, lacks only the letter "s", which is too small of a variation to be able to distinguish it from FIT Bearings' mark. Consequently, the disputed domain name is confusingly similar.

Rights or Legitimate Interests

For the following reasons, Ningbo Flight International has no rights or legitimate interests in the disputed domain name:

  1. Ningbo Flight International has not provided evidence for use of the domain name "fitbearing".
  2. FIT Bearings never permitted Ningbo Flight International to use its trade mark.
  3. There is no record that Ningbo Flight International is commonly known by the disputed domain name.
  4. There is no indication that Ningbo Flight International has been using the domain name for non-commercial or fair use.

Registered and Used in Bad Faith

FIT Bearings, www.fitbearings.com, has shown sufficient evidence that it has fame and notoriety in China, and that it has substantial business ties with China within the ball bearings and ball rings industry. In addition,
FIT Bearings and its trade mark do command a substantial reputation and goodwill within the Chinese market and the United States of America. More particularly, Ningbo Flight International appears to be in the same trade and industry as FIT Bearings and on the strength of FIT Bearings' reputation in its trade mark within the ball bearings and ball rings industry. Therefore, the compelling conclusion is that, Ningbo Flight International, by choosing to register and use a domain name which is confusingly similar to FIT Bearings' widely known and distinctive trade mark, intended to ride on the goodwill of FIT Bearings' trade mark in an attempt to exploit, for commercial gain, internet traffic destined for FIT Bearings. Potential targeted partners and end users, who are most likely to be familiar with traders in the ball bearings and ball rings industry, are led to believe that the website www.fitbearing.com is either FIT Bearings' website or a website associated with or endorsed by
FIT Bearings, or that Ningbo Flight International is the authorized partner of FIT Bearings, while in fact it is neither of these. Consequently, Ningbo Flight International, has through the use of a confusingly similar domain name, created a likelihood of confusion with FIT Bearings' trade mark, and has constituted a misrepresentation to the public. Finally, the choice of the disputed domain name and the conduct of Ningbo Flight International as far as the website on to which the domain name resolves, are indicative of registration and use of the disputed domain name in bad faith.

Decision

For all the foregoing reasons, the panel orders that the domain name, www.fitbearing.com be transferred to
FIT Bearings.

BM TRADA -- United Kingdom Accreditation Service

Since our September news, FIT Bearings has been moving right along with the BM TRADA Certification process. By year's end 2007, we hope to have earned our ISO 9001:2000 Quality Management System and ISO 14001 Environment Management System certifications for non-bearing products. Examples of products to be certified include, but are not limited to, Oil Seals, Castings, Chain, Conveyor Components, Wheel Hubs, and Mechanical Parts.

These new certifications will not only reassure our customers that FIT Bearings continuously strives for excellence in quality on all products, but also that we care about the future of our environment. These certifications will also be a testament of our sourcing and engineering capabilities.

Fremont International Trading, Inc., DBA FIT Bearings, filed a complaint against Ningbo Flight International Industrial Co., Ltd.

FIT Bearings has retained a Washington, DC law firm, Garvey Schubert Barer, in an apparent website name dispute. Commonly referred to as a Universal Resource Locator (URL), its URL, www.fitbearings.com, can easily be mistaken with Ningbo Flight International Industrial Company's URL, www.fitbearing.com. A single letter, s, is all that differentiates the two. FIT Bearings contends that its competitor is purposely and maliciously confusing consumers. Their URL does not resemble their business name whatsoever. For example, www.nfi.com would be logical and expected. Both companies are involved in bearings or industrial components with offices in China. See our Locations tab.

Established in 1988, FIT Bearings has several registered trademarks. Despite a courteous cease and desist request last December by FIT Bearings, Ningbo Flight International, established in 1997, maintains that its URL is not infringing on any other.

FIT Bearings will soon celebrate its 20th anniversary, and is commited to safeguarding all its trademarks. We look forward to a favorable outcome.

FIT Bearings seeks greater scrutiny.

In our commitment to quality, FIT Bearings has contracted with BM TRADA Certification, a leading multi-sector certification body accredited by UKAS (United Kingdom Accreditation Service). Originally established to develop quality assurance schemes in the construction industry, BM TRADA has since expanded into many other sectors including manufacturing, distribution, paper, printing, software, legal and professional services, agriculture, and food, to name a few.

We hope to earn, by year's end 2007, ISO 9000 Quality Management System and ISO 14001 Environment Management System certifications for non-bearing products. Examples include, but are not limited to, chains, conveyor components, seals, wheel hubs, and general mechanical parts.

"ISO" comes from the Greek word "'i`sos" meaning "equal." It is a word adopted by the International Organization for Standardization, loosely referred to as ISO, to mean a standard. There are thousands of ISO standards, mostly dealing with standardizing requirements for products, so that commerce, especially on an international plane, is facilitated. ISO sets standards in many businesses and technologies, including computing and communications. Please check back for updates.

The Foundation Ceremony of Shanghai FIT

June 28, 2007 - FIT Bearings broke ground on the construction of their new facility in the Shanghai SongJiang Industrial Zone today. This celebration was attended by FIT Bearings' CEO, his staff, and distinguished guests.

We began with a traditional ribbon-cutting, followed by incense lighting, the first shovels of dirt, and concluded with fireworks and noisemakers. We look forward to watching the progress of our new building and anticipate its completion. Please check back for updates.

Computer Numerical Control 3D Coordinate Measuring Machine (CNC 3D CMM) is launched

FIT Bearings has procured a CNC 3D CMM machine this month.

The CNC 3D CMM produces a precise dimensional profile of a physical object with high efficiency, reliability, and precision. Its probe registers the 2- or 3-dimensional position of a point on an object, and then transmits this data to the desktop.

For hubs in particular, this measuring device will also verify concentricity between all machined circles and drilled bolt holes.

Last April, DiversityBusiness.com recognized FIT Bearings in their 7th annual survey of U.S. businesses. Based on annual gross sales, FIT ranked within the top 100 California minority-owned businesses. A ceremony was held at the famed hotel and casino Mirage in Las Vegas.

FIT Bearings expands.

FIT Bearings supplies bearings and oil seals to the largest fastener distributor in the nation, Fastenal. Fastenal was founded in 1967 and has expanded to become the fastest growing and largest full-line industrial distributor in the nation. They have a fleet of over 275 company-owned semi-trucks and trailers, and over 2,000 stores in all 50 states, Canada, Mexico, the Dominican Republic, Puerto Rico, Singapore, Europe, and China.

FIT Bearings became their first and only oil seal supplier listed in their catalog. Our products are also prominently displayed in their stores.
